Law No. 5188: Private Security Permissions, Officer Powers and Facility Clearance
In This Article

When buying private security services, it is easy to assume that different documents mean the same thing. A company's ability to provide a service, permission to establish security at a particular location and the suitability of an individual officer are separate considerations. Distinguishing them becomes particularly useful when defence-industry documentation is also involved.

This guide provides a general framework. Your organisation's application, contract and assignment conditions should be assessed for the specific circumstances with the relevant authority and, where necessary, legal counsel. An online article or service proposal cannot replace an official permission decision.

Keep Three Core Documentation Areas Separate

Law No. 5188 regulates private security services that complement public security. It separately addresses private security permission, company operating authorisation and conditions concerning personnel. The customer's permission and the supplier's company authorisation are not interchangeable. Turkish National Police private security legislation resource.

For a practical procurement file, we recommend separating the supplier's identity and operating scope; the location's permissions and duty arrangements; and the assigned personnel's credentials and suitability. Check separately that documents are current, belong to the relevant legal entity and match the proposed activity.

The Turkish National Police provides access to an official list of companies with operating authorisation. Official records are useful for checking a company's legal name without confusing it with its marketing name. Official company and sector records.

Duty Instructions Cannot Expand Statutory Powers

The powers in Article 7 must be considered subject to their conditions and the duty-time and area framework in Article 9. An organisation's instructions cannot confer the same general powers as public law enforcement. Identity checks, screening and incident intervention should not be described through unrestricted, one-sentence claims of authority.

We recommend explaining visitor admission, delivery notifications and incident reporting through concrete duty examples. Personnel should know whom to consult when uncertain and which matters need escalation to management or public law enforcement. Communication with customers and the handling of personal data also belong in daily instructions.

Facility Security Clearance Is a Separate Matter

The Ministry of National Defence's Facility Security Clearance (TGB) and Personnel Security Clearance (KGB) processes concern defence-industry security activities and access to classified information. Ministry guidance connects KGB assessment with such access; it does not establish an automatic requirement for every private security officer. Ministry of National Defence frequently asked questions.

A factory's involvement in energy or technology alone does not determine which Ministry documentation it requires. Clarify the relevant project and activity with the competent authorities. A private security contract also cannot guarantee that facility clearance will be granted or that an inspection will have a favourable outcome.

Agree a Clear Scope Before the Service Begins

  • Define the duty area and working hours.
  • Check alignment between permissions and the contracted service.
  • Identify responsibilities for personnel changes, briefings and supervision.
  • Document incident reporting, record sharing and changes to the service.

A well-prepared scope makes the organisation's needs visible and helps prevent the parties starting with different expectations. Share your facility type and general request to explore our Manned Security Services.
