Residential Security Contracts: Authority, Data and Responsibilities

Outsourcing a residential security service does not automatically transfer every management responsibility to the provider. Instructions to officers, the use of visitor information and employment obligations involve different legal questions. A contract should therefore do more than specify staffing and a monthly price. It should explain who makes decisions, who monitors implementation and how disagreements are handled.

Instructions Do Not Replace Statutory Authority

Türkiye's Law No. 5188 connects private security powers to duties, locations and conditions. Procedures during visitor reception require assessment within that framework. An instruction from estate management does not create unrestricted powers to demand identification, search people or use force. EGM private security legislation.

Contract schedules can explain the authority and approval needed for each process. Officers should not be expected to resolve uncertainty through personal legal interpretation. Management and the provider's authorised representatives should develop workable instructions, obtaining legal advice where necessary. Immediate danger or suspected crime requires the relevant emergency and law enforcement reporting process.

Establish Responsibility for Visitor Information

Visitor names, vehicle registrations and images may be processed for different purposes. Define the purpose, legal basis, access and retention arrangements for each type of information. Holding identity documents as security or making unnecessary copies should not become routine; less intrusive verification methods should be considered.

KVKK's decision on residential management calls for examining actual decision-making and management arrangements when identifying the data controller. It is therefore inaccurate to assume that the same person is automatically responsible in every development. Who controls the information, why and how matters alongside contractual labels. KVKK decision 2020/560.

Employment Documents Do Not Eliminate Responsibility

Monitoring a provider's employment obligations forms part of management's assessment. A contribution record, insurance policy or quality certificate does not establish that every legal risk has disappeared. Whether a principal employer-subcontractor relationship exists, and its consequences, requires assessment of the actual working arrangements.

The Ministry of Labour's guidance highlights joint responsibilities where that relationship exists. A promotional promise that estate management will have no remaining liability cannot replace contract review. Ministry Labour Law questions.

Plan Handover and Closure of Access

When providers change, site information, keys, equipment, outstanding incidents and record access need a controlled handover. Continuing access for former personnel or uncertainty about who holds records can create confusion at mobilisation. Handover should be considered when the contract is prepared, rather than only when it ends.

  • Define who may issue daily instructions and approve changes.
  • Specify who checks necessary documents and the scope of those checks.
  • Explain access procedures for incident and visitor records.
  • Assign responsibility for returns, access closure and data handling when service ends.

This framework is not legal advice; the contract requires assessment for the particular development. When discussing security service scope with Titan Savunma, you can clarify duty and coordination responsibilities from the outset.
